The Challenge
Muskan’s thesis examined how Pakistani courts apply the New York Convention’s public policy exception to refuse enforcement of foreign arbitral awards, a doctrinal argument that could easily have become a wide, shallow survey of case law with no single case doing the real analytical work.
The Outcome
Working through Stage 03 and Stage 05, the thesis was built around Orient Power Company (Private) Limited v Sui Northern Gas Pipelines Limited (PLD 2019 Lahore 607) as its structural anchor, with the argument in every later chapter tested directly against what that one authority actually holds, rather than gestured at alongside a dozen others in a general literature review. The completed 18,000 word manuscript was prepared to Department of Law submission standard, its central contribution built on that single governing case rather than diluted across a wide but thin comparative survey.
